‘POPERA’ COMPETITION TERMS AND CONDITIONS

1. These terms and conditions are the Competition Rules and apply to competitions on the Popera Website. By entering the competition, entrants agree to be bound by these Rules.
2. The competition is organised by Anglian Home Improvements (a trading name of Anglian Windows Ltd).
3. Anglian Home Improvements reserves the right to cancel or amend the competition or the Rules without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside Anglian Home Improvements’ reasonable control. Any changes will be posted either within these terms and conditions.
4. In the event of any dispute regarding the Rules, conduct, results and all other matters relating to a competition, the decision of Anglian Home Improvements shall be final and no correspondence or discussion shall be entered into.
   
   

   Copyright Issues

5. Whilst all efforts will be made to ensure no unsuitable content is uploaded to the Popera site, Anglian Home Improvements will accept no liability for copyright infringement. It is the duty of the person who uploads the video to make sure no copyright infringements have been made.
   
   A few tips regarding copyright can be found below:
   
   
   1. If you have taped anything from cable/satellite TV, videotaped your TV screen or downloaded the music from a website, you still need the copyright owner's permission to distribute.
   2. It does not matter whether or not you give credit to the owner/author/songwriter - it may still be copyright infringement.
   3. It does not matter whether or not the video contains a copyright notice - it may still be copyright infringement.
   4. If you created a video made of short clips of copyrighted content - even though you edited it together, it may still be copyright infringement.
   5. It does not matter if you purchased the content at issue; whether a CD, DVD, video game, download or otherwise - it may still be copyright infringement.
   
   
   

   Qualifying Entrants

6. Employees (or members of the families or households of employees) of Anglian Home Improvements or any company involved in the competition or any advertising agency or web company connected with the competition or any such person’s subsidiary or associated companies, are not eligible to enter the competition. Anglian Home Improvements reserves the right not to award a prize (and to select an alterative winner) if Anglian Home Improvements is aware or has reasonable grounds to believe that a winner is not eligible.
7. By entering the competition, you hereby warrant that all information submitted by you is true, current and complete. Anglian Home Improvements reserves the right to verify the eligibility of all entrants.
8. The e-mail and/or home addresses you provide with your competition entry will be used to send any prizes to so please make sure this is correct. Unless stated otherwise in the Competition Notice, Competitions are only open to residents of the United Kingdom and you are not entitled to enter the Competition if you are resident outside of the United Kingdom.
9. The competition is open to all age groups, so Anglian Home Improvements assumes that by using the website and entering the Competition (and you warrant that) you are aged 18 or over or, if you are under 18, that your parents have consented to your entry into the Competition and to follow these Rules.
10. Anglian Home Improvements reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the Rules.
11. In the event that any entrant is disqualified from the Competition, Anglian Home Improvements in its sole discretion may decide whether a replacement should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.
    
    

    Entries

12. All videos uploaded to the Popera website will be subject to Anglian Home Improvements approval and if satisfied, it will be posted live to the website.
13. Anglian Home Improvements will have the last say on whether a video is considered appropriate enough to be posted live on the Popera website. Any video which is deemed inappropriate for publishing will be rejected. Reasons for rejection may include copyright infringement, inappropriate behaviour and/or language or a breaking of the competition rules. You will not be notified if your video is rejected.
14. All videos uploaded to the Popera website will be reviewed by Anglian Home Improvements and a poll will be set up each week to allow website users to vote for their favourite video of the week.
15. Anglian Home Improvements will decide which videos are to be included within the polls each week based on their chosen favourites. Anglian Home Improvements’ opinion is final.
16. To be included in the polls each week, videos will need to be uploaded by 8am on the Monday to be considered.The competition dates and closing times for entries is below:
    
    Competition 1 – Videos must be uploaded by 12pm Friday 22nd Jan 2010, poll to commence by 1pm on Friday 22nd Jan. Winners will be announced by 5:30pm on Monday 25th Jan.
    
    Competition 2 – Videos must be uploaded by 12pm Friday 29th Jan 2010, poll to commence by 1pm Friday 29th Jan. Winners will be announced by 5:30pm on Monday 1st Feb.
    
    Competition 3 – Videos must be uploaded by 12pm Friday 5th Feb 2010, poll to commence by 12pm on 1pm Friday 5th Feb. Winners will be announced by 5:30pm on Monday 8th Feb.
    
    Competition 4 – Videos must be uploaded by 12pm Friday 12th Feb 2010, poll to commence by 1pm on Friday 12th Feb. Winners will be announced by 5:30pm on Monday 15th Feb.
    
    Competition 5 – Videos must be uploaded by 12pm Friday 19th Feb 2010, poll to commence by 1pm on Friday 19th Feb. Winners will be announced by 5:30pm on Monday 22nd Feb.
    
    
17. Unless stated otherwise stated on the Popera website, you may enter the Competition as many times as you like however where a winner has been selected and Anglian Home Improvements discovers or has reasonable grounds to believe the winner has used any software or automated process either to answer questions or to make bulk entries, Anglian Home Improvements may select an alternative winner. Any further winner will be selected on the same criteria as the original winner and will be subject to these Rules.
18. There is no purchase requirement to enter a Competition and there is no charge to register for use of the website.
19. The owner of any material entered into the competition agrees that Anglian Home Improvements may use it in any other capacity of their choosing either on the Internet or in the press, media and for any other means, at any time in the future and without any payment to the owner.
    
    

    Prizes

20. Prize winners will be decided on a weekly basis from the results of the online poll on the Popera website.
21. Prize winners will be notified by e-mail of their success.
22. Should the poll winners not be available to accept their prize within 7 days of the result, the next favourite video will be chosen and contacted as the new winner.
23. Prizes will be posted out the Monday following the competition results being announced. Winners will need to provide Anglian Home Improvements with their home address in order to post them out. If the winner does not provide this information within 7 days of being contacted by Anglian Home Improvements, an alternative winner may be picked.
24. Prizes are non-transferable and there is no cash alternative. Anglian Home Improvements reserves the right to substitute prizes of equal or greater value at any time.
25. By accepting the prizes, winners consent to Anglian Home Improvements using their username, profile information & winning video (EXCLUDING personal details such as full name, address & telephone) in any further publicity; for example blog posts or PR activity.
26. Prizes are awarded at Anglian Home Improvements’ discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant.
27. Prizes will be awarded as follows:
    
    Competition 1 – Winners will be announced by 5:30pm on Monday 25th Jan, prizes will be sent out in the week commencing 25th Jan.
    • 2 x £50 Pizza Hut gift vouchers
    • Various Popera merchandise including keyrings, mouse mats & USB sticks
    
    Competition 2 – Winners will be announced by 5:30pm on Monday 1st Feb, prizes will be sent out in the week commencing 1st Feb.
    • 2 x £50 Pizza Hut gift vouchers
    • Various Popera merchandise including keyrings, mouse mats & USB sticks
    
    Competition 3 – Winners will be announced by 5:30pm on Monday 8th Feb, prizes will be sent out in the week commencing 8th Feb.
    • 2 x £50 Pizza Hut gift vouchers
    • Various Popera merchandise including keyrings, mouse mats & USB sticks
    • 3 x pairs of tickets to the Popstar to Operastar final
    
    Competition 4 – Winners will be announced by 5:30pm on Monday 15th Feb, prizes will be sent out in the week commencing 15th Feb.
    • 2 x £50 Pizza Hut gift vouchers
    • Various Popera merchandise including keyrings, mouse mats & USB sticks
    
    Competition 5 – Winners will be announced by 5:30pm on Monday 22nd Feb, prizes will be sent out in the week commencing 22nd Feb.
    • 2 x £50 Pizza Hut gift vouchers
    • Various Popera merchandise including keyrings, mouse mats & USB sticks
    • A European holiday - £600 of Thomas Cook Vouchers
    
    
    
28. For the holiday prize, £600 of Thomas Cook vouchers will be issued. All taxes, insurances, transfers, spending money and other expenses (including personal expenses upgrades etc.) as the case may be, unless specifically stated, are the sole responsibility of the prize winner.
29. For the holiday prize, holidays must be booked before Jan 1st 2011, but can be taken after this date.
    
    

    Intellectual Property Rights & Use of Entries

30. Each entrant agrees that Anglian Home Improvements (and third parties authorised by Anglian Home Improvements) may make any and all Entries available on the website and any other media, whether now known or invented in the future, which may include other internet sites, mobile, television and/or radio and that Entries may be made available with advertising and/or sponsorship. You now grant Anglian Home Improvements (and third parties authorised by Anglian Home Improvements) a non-exclusive, worldwide, irrevocable licence to use, display, publish, transmit, copy, make derivative works or podcasts from, edit, alter, store, re-format, sell and sub-licence the Entry for such purposes.
31. Anglian Home Improvements does not guarantee to use or otherwise make available any Entry. Anglian Home Improvements may also, in appropriate circumstances, and at its sole discretion, reject, edit, remove or disable access to Entries that appear to be legally or otherwise problematic e.g. infringe the copyright or other intellectual property or privacy rights of others, are defamatory etc. or for any other reason.
    
    

    Liability

32. Anglian Home Improvements cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize. Anglian Home Improvements is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination of these, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition.
    
    

    Data Protection and Publicity

33. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual’s prior consent. Data relating to entrants may be retained by Anglian Home Improvements for a reasonable period after the Competition closes to assist Anglian Home Improvements to operate future competitions in a consistent manner and to deal with any queries on the Competition.
    
    

    Jurisdiction

34. The competition and Rules will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England. The website is only intended to be accessed from the United Kingdom. Anglian Home Improvements makes no representation that materials on the Site relating to this Competition are appropriate or available for use at other locations and access to them from territories where their contents are illegal is strictly prohibited. If you access the Site outside of the United Kingdom, you are responsible for compliance with all local laws.
